Background TV a threat to U.S. kids, researchers say

NEW YORK (Reuters Health) - That clamor in the background? It's probably the TV, and it might be taking a toll on your toddler's development, researchers say.

According to the first national estimate of background television exposure, children in the U.S. spend nearly as much time around a switched-on television as they do in school.

Between the age of eight months and eight years, kids spend an average of 232 minutes a day with the TV droning on in the background, researchers found. Add to that the 80 minutes of active watching that previous studies have found, and you land at just over five hours of daily interaction with the electronic babysitter.

"It's quite an alarming study," said Dr. Victor Strasburger, a pediatrician who has studied media use in youngsters, but was not involved in the new survey.

"This is a clear warning signal to parents that if they are not watching TV, they ought to turn it off, and a reminder that parents should be avoiding screen time in infants under two," added Strasburger, of the University of New Mexico in Albuquerque.

The results are based on nationally representative telephone interviews with close to 1,500 parents, who reported their child's activities over the past 24 hours and whether there was a TV on in the background.

The effects of screen time on developing brains and minds are not well understood, but researchers say concerning findings are emerging.

For instance, children spend less time playing with friends and interacting with parents when a TV is clamoring in the background than when there is no such distraction, said Matthew Lapierre of the University of North Carolina Wilmington, who led the new survey.

"We definitely need to rethink this sort of exposure," he told Reuters Health. "You have learned how to deal with this, but what does it mean for a very young child?"

Lapierre and his colleagues found that the younger children were, the more background TV they were exposed to. Toddlers under two, for example, spent 5.5 hours around the screen daily.

Kids with a TV in the bedroom and African Americans also had more exposure, according to the report, published Monday in the journal Pediatrics.

The American Academy of Pediatrics recommends limiting media time for kids to less than two hours per day, keeping the TV set and Internet out of the bedroom and avoiding screen time for kids under two.

Surfing the Web or watching TV before bedtime has been linked to sleep problems and drowsiness during the day in kids. Researchers also worry that screen time may lead youth to snack more and to pick up bad habits, such as smoking and drinking in excess.

For infants and toddlers, studies suggest the din from a TV may slow down language development, according to Strasburger.

"Think about it," he said. "It's confusing for babies who are trying to get their language together to have indistinguishable voices in the background."

Strasburger said young infants distinguish between people on TV and flesh-and-blood humans, and they learn better from the latter. When he walks into an examination room, the pediatrician added, he can tell which toddlers are watching TV and which ones have parents reading to them.

"The babies that are being read to are just chattering away, and the babies that sit in front of a TV are silent," he said. "It means their language development is threatened - they may catch up, but it's a concern."

(AP) ? The New York Jets were a delicious treat for the San Francisco 49ers.

San Francisco used a solid running game, a smothering defense, a little bit of the wildcat-style offense and even blocked a punt to cruise to a 34-0 victory. That romp came a week after a loss at Minnesota in which the 49ers were just as outclassed as the Jets were Sunday.

"For sure, the whole week there was more of an edge; it was just a bad taste in your mouth," Alex Smith said. "I don't think that goes away in one day. We wanted to be 3-1 and got it done."

They got it done so emphatically that Jets coach Rex Ryan was visibly shaken by the lopsided defeat, so much so that he struggled to describe how poorly his Jets (2-2) performed.

"It's obviously unacceptable," Ryan said. "It starts with the coaches. The players ... they've got to dig deep, look down at the themselves."

Ryan took no solace from his team losing to one of the NFL's best. San Francisco (3-1) has everything Ryan wishes his team did.

The 49ers ran for 245 yards and Carlos Rogers returned a fumble 51 yards for a touchdown.

Frank Gore, Kendall Hunter and backup quarterback Colin Kaepernick ? on a wildcat-like option ? all ran for scores. The defense had an interception and three fumble recoveries, and special teams blocked Robert Malone's punt to set up the final touchdown.

Defensive end Aldon Smith called it a statement win.

"Yeah, that's right," he said. "After the last game, some people were questioning us and we knew what we were capable of. We played all together as a unit and proved what we are as a defense."

And as an offense. And on special teams.

Rather than head back to the West Coast after the Minnesota loss, coach Jim Harbaugh chose to have his team stay in eastern Ohio and practice at Youngstown State all week. Last season, the 49ers did the same thing and won both games, in Cincinnati and then at Philadelphia. The 49ers wound up going to the NFC championship that season, and if they play anything like they did against the Jets, they could very well find themselves advancing deep into the postseason again.

"This is more the way we are accustomed to playing," said Harbaugh, the 2011 Coach of the Year.

It was San Francisco's first shutout since beating the St. Louis Rams 26-0 last December.

Meanwhile, the Jets lost top wide receiver Santonio Holmes to what appeared to be a serious left foot injury. It was the first time New York was shut out since losing 9-0 to Green Bay on Oct. 31, 2010, and the Jets' biggest shutout home loss since falling 37-0 to Buffalo in 1989.

If Holmes misses significant time, the Jets would be without their two biggest playmakers after All-Pro cornerback Darrelle Revis was likely lost for the season with a torn ligament in his left knee last week at Miami.

"We got to play with who we've got," Mark Sanchez said. "None of those guys are going to get better overnight."

On the first play of the fourth quarter, Holmes caught a pass from Sanchez for 4 yards, but his left leg appeared to go out on him. The ball flew out of his hands, and Rogers picked it up and returned it for a score.

Holmes left the stadium in a golf cart, holding crutches, his left foot in a boot.

Ryan said Friday that the Jets would wait to put Revis on injured reserve until he has surgery in a few weeks, keeping him available in case New York goes to the Super Bowl. If the Jets play like this the rest of the way, getting to the playoffs will be a tall task.

Alex Smith was efficient, going 12 of 21 for 143 yards and no touchdowns, but more importantly, no interceptions. Sanchez had another poor game, going 13 of 29 for 103 yards and an interception.

"We knew Sanchez holds the ball a little longer and we felt we could get after him," Aldon Smith said. "We pretty much did."

New York finished with just 45 yards rushing.

The wildcat-style offense worked early ? but for the 49ers and not Tim Tebow and the Jets.

Kaepernick put the 49ers up 7-0 early in the second quarter, taking a direct snap and running untouched off left end for a 7-yard touchdown. Kaepernick also had a 17-yard run earlier in the game.

On the Jets' next possession, Tebow threw his first pass with New York, a short one over the middle to tight end Dedrick Epps, who was upended immediately by Dashon Goldson as the ball came loose. Rogers recovered, and the fumble call was upheld by video review. Epps injured his right knee on the play.

With just over a minute left in the first half, the 49ers were aggressive despite starting the drive at their 26. A 23-yard catch by Vernon Davis on first down got things rolling, and San Francisco ended the half on David Akers' 36-yard field goal.

Boos and some chants of "Tee-boww! Tee-boww!" rang out as the Jets went three-and-out for the second straight possession in the second half. It never got any better for New York.

NOTES: Mario Manningham, a Super Bowl hero with Giants before joining the Niners as free agent, returned to the Meadowlands and had three catches for 47 yards, plus a 28-yard gain on an end-around ... Akers also missed from 55 and 40 yards wide right ... New York lost fullback John Conner with a hamstring injury ... San Francisco got 62 yards rushing from Gore, 56 from Hunter and 50 from Kaepernick.

Georgia's president, opposition both claim victory

TBILISI, Georgia (AP) ? Georgian President Mikhail Saakashvili and the opposition both claimed victory Monday in a parliamentary election that is crucial to determining the future direction of this former Soviet republic.

The governing party was in a heated race against an opposition coalition led by Bidzina Ivanishvili, a billionaire businessman who has posed the most serious challenge to the pro-Western president since he came to power almost nine years ago.

No results have been released yet in Monday's vote. Two exit polls conducted by Edison Research and Gfk gave the edge to the opposition, but they were done four hours before the voting stations closed and registered only the vote based on party lists, which is used to elect 77 of parliament's 150 members.

The remaining 73 members are directly elected by majority vote in their constituencies, where the president's United National Movement is considered to have a strong advantage.

Saakashvili, speaking on television shortly after the polls closed, said the opposition coalition Georgian Dream had indeed won the party vote, largely on the strength of its support in the capital, Tbilisi. Still, he said his party was far ahead in the direct elections and would retain its majority in parliament.

Georgian Dream, however, released a statement saying that its own exit polls showed it would win the party vote by 63 percent and cited Ivanishvili saying he was "prepared to ensure a parliamentary majority."

The Central Election Commission said the first preliminary results were expected at 3 a.m. Tuesday (2300GMT, 7 p.m. EST Monday).

Emotions were running high, but both sides have promised to respect the results if the election receives the approval of international observers.

The U.S. ambassador joined calls for a peaceful election.

"I encourage the public to remain calm, have faith and be patient while all the results are counted and any challenges are properly evaluated," Ambassador Richard Norland said.

Under Saakashvili, the former Soviet republic has aligned itself with the United States, while striving to join the European Union and NATO.

Ivanishvili, who made his money in Russia, has said he would pursue these strategic goals while also seeking to restore the ties with Moscow that were severed when the two neighboring countries fought a brief war in 2008.

Saakashvili has accused Ivanishvili of serving Kremlin interests and intending to put Georgia back under Russian domination, which the opposition leader has denied.

After casting his vote on Monday, Saakashvili said the election was important not only for Georgia, a nation of 4.5 million on the Black Sea, but for the region.

"A lot of things are being decided right now in our country ... for the future not only of this nation, but for what happens to the European dream in this part of the world, what happens to the idea of democracy in this part of the world, what happens to the idea of reforms in this part of the world." he said, his Dutch wife and their young son standing behind him.

The opposition has accused Saakashvili of authoritarian rule.

"Without a doubt, Saakashvili and all of his people should leave," said Mamuka Gigienishvili, a 55-year-old physicist who voted in Tbilisi. "We have had enough of him acting like a czar."

She said his party "labeled anyone with a different opinion a traitor ... as if only they were able to lead the country in the right direction."

Saakashvili's campaign was hit hard by the release two weeks ago of shocking videos showing prisoners in a Tbilisi jail being beaten and sodomized. The government moved quickly to stem the anger, replacing Cabinet ministers blamed for the abuse and arresting prison staff, but many saw the videos as illustrating the excesses of his government.

Veriko Berishvili, a 49-year-old small business owner, pointed to all that Saakashvili had done to reform Georgia since coming to power in early 2004. She specifically named the disbanding of the corrupt traffic police and creation of a modern force, a widely praised program carried out by Saakashvili's longtime interior minister whom he named prime minister in June.

"I think we should allow this team to fulfill its promises: to improve the situation in agriculture, decide the problem of joblessness, universal health insurance," she said. "Look at his baby, the police force. It is the best in the former Soviet Union."

Saakashvili has taken a zero-tolerance approach to crime, which has eradicated petty corruption and made the streets safe again. The flip side has been a huge increase in the prison population and the power of the prosecutors, who win convictions in more than 90 percent of cases.

He also enacted reforms and attracted foreign investment that together produced dramatic economic growth. Poverty and unemployment rates, however, remain high.

Ivanishvili, the opposition leader, expressed confidence earlier Monday that his coalition would win.

"For the first time in Georgian history the Georgian people are managing to conduct really democratic elections, or elections which are very close to being democratic because the government has made many violations already," he said. "There were many violations before election day and I think there will be violations today, too, but the wisdom of the Georgian people and historic experience has helped us to make it possible for the first time to change the government through elections."

Saakashvili came to power after anger over a rigged parliamentary election in November 2003 led to the Rose Revolution and the ouster of Eduard Shevardnadze, who had taken power in 1992 after a military coup.

Saakashvili won a presidential election in January 2004 with 96 percent of the vote and reelection four years later.

His United National Movement has held 119 of the 150 seats in parliament.

Monday's election sets in motion a change in the political system that will reduce the powers of the presidency. The party that wins the majority in parliament will have the right to name the prime minister. When Saakashvili's second and last term ends next year, many of the president's powers will be transferred to the prime minister.

If Saakashvili's party wins on Monday, he has said he does not intend to become prime minister after the presidential election in October 2013. Such a job swap would bring unwelcome comparisons to Russian President Vladimir Putin, who served for four years as prime minister to avoid a constitutional ban on more than two consecutive terms as president.

Ivanishvili is not running for a seat in parliament, but has said that if his Georgian Dream coalition wins he would serve as prime minister at least for a year or two to put his team in place.

Mo. abuse case poses question of consent vs. crime

(AP) ? Advocates for people who engage in rough but consensual sex say they fear an abuse case unfolding in Missouri ultimately could criminalize their lifestyle.

Ed Bagley faces a federal trial early next year on 11 counts of abuse against a woman authorities say he groomed to be his sex slave. Now prosecutors plan to present consensual, though violent, acts between Bagley and his own wife as evidence that Bagley has a history of sexually assaulting women.

The case will include evidence of "sadistic sexual assaults" committed by Bagley against his wife, Marilyn, prosecutors say.

"Marilyn Bagley's 'consent' to the sexual assaults by Defendant Edward Bagley does not change whether the acts legally constitute assault or not. Pursuant to the Missouri state assault statute ... consent is not a defense to assault resulting in serious physical injury," prosecutors wrote in court documents filed last month.

Some worry the government's assertion could open up people who practice bondage, dominance, sadism and masochism ? or BDSM ? to criminal charges for consensual acts they're already performing, said Susan Wright, founder of the Baltimore-based National Coalition for Sexual Freedom.

"We are following this case specifically because we were hoping this issue would not come up," she said.

Ed Bagley, 45, of Lebanon, Mo., is accused of grooming a young woman to be his sex slave starting in 2002, then keeping her captive for years while making money from her images on fetish Internet sites and forcing her to work as a dancer at strip clubs. Marilyn Bagley, 47, is charged with five counts, including sex trafficking and forced labor trafficking.

Both have pleaded not guilty and are scheduled for trial in February.

Prosecutors claim Bagley, known as "Master Ed," tortured the young woman and made her available to other men who came to his trailer, either to torture or have sex with her. Four men, who said they visited Bagley's trailer to watch or take part, have pleaded guilty to conspiracy charges.

The case came to light in early 2009 after the woman, then 23, was hospitalized after what prosecutors said was a torture session. Then-U.S. Attorney Beth Phillips called the case one of "the most horrific ever prosecuted in this district."

Advocates for the BDSM community say even the most brutal acts detailed in Bagley's federal indictment are not criminal acts, as long as there was consent. But if the woman was too young or not intelligent enough to consent, as prosecutors allege, or if she initially gave consent and then changed her mind, most who spoke with the AP said that would be criminal sexual abuse.

It's the inclusion of Bagley's acts with his wife in the case that concerns BDSM advocates and Bagley's attorney, Susan Dill.

"Like many people from all walks of life, my client and his wife engaged in what some might term alternative, but nonetheless, consensual sexual activity that they both enjoyed," Dill said in an email to The Associated Press. "The assertion that their consensual, marital sex life is evidence of prior criminal activity is nonsensical."

As in several other states, Missouri assault laws limit instances in which consent can be used as a defense against criminal charges when serious injuries occur. Exceptions generally are made for athletic activities and the victim's occupation or professions in which the conduct and harm are reasonably foreseeable hazards.

Wright's group contends "serious physical injury" is not well-defined under law.

"The assessment of the seriousness of harm is often affected by judges' 'moral judgments about the iniquity of the conduct,'" the organization says on its website in a section focusing on the consent issue. "Courts tend to inflate the risk and harmfulness of an activity they want to denounce. For example, any injury caused during a sadomasochistic encounter has been consistently classified as serious."

Diana Adams, a New York attorney and sexual freedom activist who represents clients in alternative lifestyles, said the landmark 2003 U.S. Supreme Court ruling "Lawrence v. Texas" that struck down a Texas anti-sodomy law "declared we had a right to consensual sex between adults in the privacy of our own homes," but that the law is not clearly defined.

"In this kind of case, sometimes it's selectively applied," Adams said.

She said federal courts in Texas and Alabama interpreted the Lawrence decision in different ways in 2004. The Texas court used the case to strike down a ban on sales of sex toys, citing Lawrence's privacy conclusion. The Alabama court, however, upheld a similar ban by saying commercial sale of the toys was an issue of obscenity, not privacy.

Wright notes that regardless of the legal precedent, prosecutors' attempts to present acts between Bagley and his wife as evidence in the Missouri case also comes at a time when kinky sex practices appear to be gaining broader public acceptance amid the popularity of the E.L. James "50 Shades of Grey" bondage books.

"Because of '50 Shades of Grey,' a lot of people are trying BDSM for the first time this year," she said. "We want to be sure they understand they have to do these activities consensually, and to make sure they have the skill to do them safely."
